1. About these terms
These terms apply to services ordered through this website or agreed in writing with Joshua Dearden, trading as Joshua Dearden App Development ("I", "me"), 2 Cwmcarn Close, St Mellons, Cardiff, CF3 0HA, United Kingdom. "You" means the person or business ordering the service. By placing an order, you accept these terms.
2. The services
Each service is described on its own page. The package price covers the baseline scope described there. Some services include options that depend on your project, such as which features, screens or integrations are needed; these are confirmed with you before work starts.
3. Scope, quotes and changes
- After you order, I contact you to confirm requirements. The agreed scope is confirmed in writing, and email is fine.
- Work outside the agreed scope is a change request. I'll quote it separately and won't start it without your approval.
- Written quotes for custom projects are valid for 30 days unless they say otherwise.
4. Ordering and payment
- Prices are shown in pounds sterling. Any VAT that applies is shown before you pay.
- Online orders are paid in full by card through Stripe's secure checkout. Custom projects may be paid in stages set out in the written quote.
- Your order is accepted when payment is confirmed. If I can't take on the work, I'll tell you promptly and refund you in full.
5. Your responsibilities
- Provide accurate information, content, feedback and any access I need, within a reasonable time. Delays in providing these may move the timeline.
- Make sure you have the right to use any content, branding, data or materials you give me.
- Set up and pay for the accounts your app needs in your own name, such as the Apple Developer Program or Google Play Console, unless we agree otherwise.
- Make sure your app and its content comply with the laws that apply to your business, including providing your own privacy policy to your app's users.
6. Third-party costs and services
Package prices don't include third-party costs such as developer account fees, hosting, domain names, paid APIs, software licences or subscriptions, unless agreed separately. Third-party services are provided under their own terms, and I'm not responsible for their availability, pricing changes or policies.
7. App store publication
I prepare your build, store listing and supporting information and help with submission. Apple and Google decide whether to approve an app and how long review takes, so approval and timing can't be guaranteed. If reviewers ask for changes within the agreed scope, I'll make them. Changes that go beyond the agreed scope are quoted separately.
8. Timelines
Timelines are estimates based on the agreed scope. I'll keep you informed of progress and tell you as early as possible if anything is likely to affect the schedule.
9. Delivery and acceptance
When work is delivered, please review it within 10 working days and tell me about anything that doesn't match the agreed scope. I'll correct those points before the work is treated as accepted.
10. Fixing defects
If you report a defect in work I delivered within 30 days of handover, I'll fix it at no extra cost. This doesn't cover changes made by anyone else, changes to third-party services, operating system versions released after handover, or new features.
11. Intellectual property
- Once the project is paid in full, ownership of the code, designs and other materials created specifically for you passes to you.
- I keep ownership of my pre-existing tools, code libraries and know-how. Where any of these are included in your project, you receive a permanent, non-exclusive licence to use them as part of your app.
- Open-source components remain subject to their own licences.
- I'll only mention our work together in a portfolio with your permission.
12. Confidentiality
I keep the information you share about your business and project confidential and use it only to deliver the services. I'm happy to sign a reasonable non-disclosure agreement on request.
13. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.
- If you're a consumer, you have legal rights under the Consumer Rights Act 2015, including the right to services performed with reasonable care and skill. These terms don't affect those rights.
- If you're a business customer, my total liability for any claim is limited to the price paid for the service concerned, and I'm not liable for loss of profit, revenue, business or data, or for any indirect loss.
- I'm not responsible for losses caused by third-party services or by app store decisions. Please keep your own backups of your data and content.
14. Cancellation and ending the contract
Your cancellation rights are set out in the Refund Policy. I may end the contract if you don't pay amounts due or seriously breach these terms and don't put it right within 14 days of being asked. In that case, you pay for the work done up to that point.
15. Complaints
If you're unhappy with any part of the service, please contact me at joshua_dearden@outlook.com so I can put it right.
16. Governing law
These terms are governed by the law of England and Wales, and disputes will be handled by the courts of England and Wales. If you're a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
